In mediation, you and your spouse or significant other create the terms of your divorce, separation, custody or child support agreement (parenting plan) rather than hire attorneys to create it for you, which more often than not, result in elevated stress and high legal fees. Unlike attorneys, mediators are neutral and do not represent one party or the other. Mediation allows for the clients to represent themselves to amicably work out an agreement that both clients find fair and equitable with the assistance of a professional trained in conflict resolution.
Mediation is voluntary and allows for the parties to be in control of their decisions rather than attorneys. All mediation sessions are conducted with both clients and all correspondence is shared to ensure transparency of the process. As a result of the voluntary process, mediation is less time consuming which becomes less expensive than typical matrimonial and family matters that involve attorneys.
Both clients will be provided an information intake to complete prior to the first mediation session. The intake breaks down a multitude of matters that may need to be addressed at mediation. After the intakes are completed, the clients will meet with the mediator to discuss options and resolutions to any issues. Because most people work during the week, our office is open every weekend for the mediation sessions to allow clients to come in absent the stress and exhaustion a workday brings.
After the issues have been discussed and worked out, a Memorandum of Understanding is prepared, (this is an outline of the matters discussed). Once the clients have agreed to the terms set forth in the Memorandum of Understanding, a stipulation, settlement or separation agreement, is scribed with the contents of the Memorandum. Prior to signing the stipulation or agreement, we encourage both parties to seek an independent attorney review.
